Can I leave my own furniture in the Garden ?
No, unless you have written permission from the Committee. You can bring your own items in but you need to take them with you when you leave for the day.

What if I lose my key ?
Please contact us and we will arrange for a replacement key. There will be a charge for the replacement key.

Can I join the Committee?

Garden Furniture/Items

The Committee purchase garden furniture for everyone to enjoy.
If you wish to bring your own furniture into the gardens , that is fine but it must be removed with you when you leave for the day - no overnights !
If you would like to introduce any item into the Gardens to be left long term, permission is needed from the Committee and be aware that the item will be available for all garden users to use.

We ask that everyone behaves in a considerate way and dog owners, please keep your pets under control at all times and ensure that dog poo is lifted and binned!
Maintenance Fees

Fee
The annual maintenance fee is due on 1 April each year.
Amount
Fees: April 2024 - March 2025

£240 per annum discounted to £200 for prompt payment

No prompt-payment discount for any new non-proprietor subscribers. Existing terms for current non-proprietor subscribers are unchanged
How the fee is agreed
The fee is proposed by the Committee based on anticipated annual spend and levels of reserves and circulated to proprietors before the AGM where it is discussed and agreed.
Fee Notification
Annual maintenance fee notice will be sent to owners and external key holders in March of each year and we ask you to pay promptly.
Owners
Owners of properties in Magdala Crescent have an automatic right to a key and an obligation to pay the annual maintenance fee, as documented in their title deeds.
Owners of Let Properties in Magdala Crescent
The responsibility for payment of fees rests with the owner of each individual property in Magdala Crescent who will be sent a Subscription Notice in March each year.
It is a matter for the owner/landlord if they wish to recoup the amount of the fees from the tenant.
Payment of fees should always be made directly by the proprietor to the Association regardless of any personal arrangement.
Non Proprietors
There is no prompt-payment discount for any new non-proprietor subscribers who will pay the full fee (or pro-rata amount depending on when they join).
Existing terms for current non-proprietor subscribers are unchanged.

Owners
Owners of properties in Magdala Crescent have an automatic right to a key and an obligation to pay the annual maintenance fee. This obligation is documented (in legal speak!) in the title deeds.
Tenants in Magdala Crescent
It is a matter for agreement between the owner/landlord and the tenant as to whether the tenant should be allowed to use the gardens although normally the tenant would be allowed access.
Non Proprietors
We welcome people who live adjacent to Magdala Crescent to apply and become external key holders. There is £100 deposit for the key for non proprietors only, returnable when they hand back the key on ceasing to to use the Gardens.

Applicants are asked to make it clear whether or not they plan to walk a dog in the gardens as we have separate lists for dog and non dog owners.

GDPR

The Committee hold personal information in respect of all the subscribers to the Gardens including both proprietors of property in Magdala Crescent and non-proprietors who also use the Gardens.
The purpose of storing personal data is to ensure the ongoing management of the Gardens in particular in relation to sending out the Annual Subscription Notice, notifying the AGM and informing the subscribers of any other relevant information.

The Committee have agreed a Data Management Policy which includes information in respect of any breach of security occurring re the holding of personal information. This is sent to all proprietors of property in Magdala Crescent immediately they complete title.
At the same time proprietors are sent a Privacy Notice, also agreed by the Committee, which sets out the principles applying to the retention of personal data. All proprietors should already have copies of these documents.

The Committee have agreed a separate Privacy Notice which is supplied to all non-proprietor subscribers immediately before they are issued with a key to to the Gardens.

This document is similar to the Privacy Notice which applies to proprietors. Non-proprietors are required to sign a Consent Form immediately they become subscribers which includes consent to the Association holding their personal information.

Each non-proprietor subscriber should have a copy of both these documents but can apply to the Secretary for further copies as set out above.
